Terms of Service

The terms governing use of The Schulz Agency website, Family Protection Navigator™, insurance reviews, quote support, applications, and policy-service assistance.

Insurance coverage is controlled by the issuing carrier and the policy contract. These Terms govern TSA website and service use; they do not replace carrier forms, applications, disclosures, or issued policies.

01Acceptance of Terms

By visiting tsa.thepeoplestrusts.com, using the TSA Family Protection Navigator™, submitting a form, scheduling a consultation, requesting a quote, applying for coverage, electronically accepting documents, or otherwise using TSA services, you agree to these Terms of Service and the incorporated Privacy Policy, Disclaimers, Legal Addendum, carrier documents, applications, and any service-specific written terms.

02Operator and Defined Parties

The Schulz Agency is an insurance-focused brand operated by The Peoples Trusts Consulting LLC. "TSA," "we," "us," and "our" refer to the operator and appropriately licensed representatives acting within the scope of the requested service. "You" refers to the website visitor, applicant, proposed insured, policy owner, payer, authorized representative, or service user.

03Eligibility and Authority

You must be at least 18 years old and legally capable of entering agreements, or be an authorized representative acting with lawful authority. You must not submit information or instructions for another person without appropriate permission. Business applicants must have authority to act for the business and establish insurable interest where required.

04Services Covered

TSA provides insurance education, coverage-gap review, readiness tools, private health insurance guidance, life insurance guidance, indexed universal life insurance guidance, quote and application support, and policy-service coordination. Services are limited by licensing, appointment status, state law, carrier rules, product availability, and applicant eligibility.

05Licensing and Appointment Requirements

Insurance may be transacted only through a properly licensed person with any appointment required by applicable law and carrier rules. A license alone does not guarantee active appointment with every insurer or authority to offer every product. TSA may decline, refer, or limit a request when licensing, appointment, geography, carrier, suitability, or compliance requirements are not satisfied.

06Navigator, Readiness Scores, and Educational Tools

The TSA Family Protection Navigator™, readiness scores, summaries, worksheets, and educational materials are preliminary decision-support tools. They are based on information supplied by the user and generalized review logic. They are not insurance applications, underwriting decisions, quotes, policy illustrations, coverage confirmations, medical advice, or guarantees of eligibility or price.

07Quotes, Comparisons, and Illustrations

Quotes, comparisons, projections, and policy illustrations are estimates or carrier-generated materials based on then-current information and assumptions. They may change after underwriting, verification, carrier review, product updates, age changes, health changes, premium design, or state requirements. Only the issued policy and carrier-approved documents control.

08Applicant Accuracy and Continuing Duty to Update

You must provide complete, truthful, and current information. Do not omit or misstate health, tobacco, financial, replacement, identity, residency, or eligibility information. Material inaccuracies may affect underwriting, pricing, issuance, contestability, claims, benefits, cancellation, rescission, or policy validity. You must promptly correct information that changes before policy issuance.

09Underwriting and Carrier Control

Carriers independently determine eligibility, underwriting class, rates, exclusions, riders, benefits, effective dates, renewals, claims, and policy issuance. They may require medical or prescription review, identity verification, financial justification, replacement forms, interviews, exams, records, or other evidence. TSA does not control or guarantee carrier decisions.

10No Coverage Until Carrier Confirmation

No conversation, navigator result, quote, illustration, recommendation, application, premium submission, receipt, or electronic signature creates coverage by itself. Coverage exists only when the carrier has approved and issued the policy, all conditions are satisfied, required premium is accepted, and the carrier confirms the effective date. Do not cancel or replace existing coverage until new coverage is confirmed in force and applicable review periods have been considered.

11Private Health Insurance Terms

Private health products may include eligibility restrictions, exclusions, waiting periods, limited benefits, network requirements, preauthorization rules, formularies, deductibles, copayments, coinsurance, maximums, and renewal limitations. You are responsible for confirming providers, facilities, prescriptions, benefits, costs, geographic access, and effective dates directly with the carrier before relying on coverage.

12Life and Indexed Universal Life Insurance Terms

Life and IUL policies may include mortality charges, administrative expenses, premium flexibility, surrender charges, interest or index-crediting limits, caps, participation rates, spreads, policy loans, loan interest, withdrawal effects, non-guaranteed values, lapse risk, and tax consequences. Index credits are not direct investments in a market index. Illustrations depend on assumptions and are not guarantees. You are responsible for reviewing the policy contract, guaranteed values, non-guaranteed assumptions, funding design, beneficiaries, ownership, and ongoing performance.

13Service-Scope Exclusion

Although Florida license classifications may include broader authority, TSA does not market or offer variable life insurance or annuity products through this website. Nothing on these pages should be interpreted as a securities solicitation, annuity recommendation, or variable-product offer.

14Premiums, Fees, and Payments

Insurance premiums are paid according to carrier instructions and are governed by the policy and carrier rules. TSA does not set carrier premiums. Any separate service, diagnostic, or administrative fee must be disclosed in writing before it is charged. You authorize agreed payment methods and are responsible for returned-payment charges or other disclosed costs where permitted by law.

15Cancellations, Free-Look Rights, and Replacements

Policy cancellation, refund, surrender, rescission, and free-look rights are controlled by the issued policy, carrier rules, and applicable law. Replacing or surrendering coverage may create surrender charges, restart contestability or suicide periods, require new underwriting, cause tax effects, or leave a coverage gap. Never terminate existing coverage solely because an application has been submitted.

16Electronic Communications and Signatures

You consent to receive agreements, disclosures, forms, notices, invoices, and service records electronically. Electronic acceptance, checkbox acceptance, typed names, and compliant electronic signatures may be treated as originals. You are responsible for providing a working email address and reviewing carrier and TSA communications promptly.

17Privacy and Information Handling

Your use of TSA services is subject to the Privacy Policy. You authorize TSA to use and disclose information as reasonably necessary to evaluate, quote, apply for, issue, and service insurance, subject to applicable law and carrier requirements. Do not send unnecessary sensitive information through unsecured channels.

18Intellectual Property and Acceptable Use

The TSA website, Family Protection Navigator™, readiness logic, summaries, designs, text, forms, graphics, branding, and original materials are owned by or licensed to TSA and protected by law. You may use them only for your personal insurance review. You may not copy, scrape, resell, reverse engineer, publish, or create derivative commercial products without written permission.

You may not misuse the site, submit fraudulent information, impersonate others, interfere with systems, introduce malicious code, harvest data, or use TSA services for unlawful, deceptive, or abusive activity.

19Third-Party Carriers and Platforms

Carriers, general agencies, quoting systems, medical-data vendors, payment processors, communications providers, and other third parties operate under their own terms. TSA is not responsible for their outages, pricing changes, data practices, underwriting decisions, claims determinations, policy administration, or service interruptions.

20No Warranties

To the fullest extent permitted by law, the website, navigator, educational materials, and administrative services are provided "as is" and "as available." TSA disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, uninterrupted operation, accuracy, and specific results, except where prohibited by law or expressly stated in an enforceable written agreement.

21Limitation of Liability

To the fullest extent permitted by law, TSA, The Peoples Trusts Consulting LLC, and their owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost income; lost opportunity; loss of data; business interruption; or damages caused by carrier, platform, underwriting, claim, network, provider, or third-party decisions.

For a claim arising from a specific paid non-premium service, aggregate liability will not exceed the amount actually paid to TSA for that service during the six months preceding the event giving rise to the claim, unless applicable law requires otherwise. This limitation does not alter rights that cannot legally be waived.

22Indemnification

You agree to defend, indemnify, and hold harmless TSA, The Peoples Trusts Consulting LLC, and their owners, officers, employees, contractors, and representatives from claims, losses, liabilities, damages, and reasonable costs arising from your fraud, unlawful conduct, inaccurate or unauthorized submissions, misuse of services, violation of third-party rights, or breach of these Terms.

23Suspension, Refusal, and Termination

TSA may refuse, suspend, or terminate website access or services for nonpayment, fraud concerns, abusive conduct, incomplete or inaccurate information, licensing or appointment limits, carrier or regulatory risk, unlawful activity, conflicts, or inability to continue. Provisions intended to survive termination remain effective.

24Governing Law and Venue

These Terms are governed by Florida law, without regard to conflict-of-law rules, except where another law must apply. Any permitted court proceeding must be brought in Broward County, Florida, and the parties consent to that jurisdiction and venue.

25Severability, Waiver, Assignment, and Order of Control

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent. TSA may assign them in connection with a reorganization, sale, or transfer of operations.

For insurance coverage, the issued policy and carrier-approved documents control over website content. For TSA services, a signed service-specific agreement controls over these Terms to the extent of an express conflict.

26Changes to Terms

TSA may update these Terms prospectively by posting a revised version with a new effective date. Existing issued policies remain governed by their contracts and applicable law.
